Course Description

It is the responsibility of employers to ensure they meet legislative requirements in relation to employee entitlements when buying or selling a business.

This module explains the transfer of business decision-making process, and options for employee matters in a sale of business.

  • Understand the decision-making process and options for employee matters in a sale of business;
     
  • Understand what are transferring employees & what industrial instrument covers transferring vs new employees;
     
  • Understand transfer of service-related entitlements in transfer of business, including what is, and is not, negotiable in the Sale of Business agreement;
     
  • Understand record keeping obligations of vendor & purchaser;
  • Understand Employee Contract documentation requirements for transferring employees.
